Terms and conditions

Welcome! You have arrived at a site that is owned and/or operated by NO_YA the brand (“we”, “our”, “us). These Terms and Conditions of Service (“Terms”) govern your use of https://noyathebrand.com/. The following terms and conditions apply to all agreements that the customer (hereinafter “you”) meets with www.noyathebrand.com. By using this website and / or placing an order with us, you agree to the terms and conditions that apply to us. Make sure you have read and understand the terms and conditions that apply to us before you place your order. We reserve the right to change these terms and conditions from time to time without giving prior notice to the customer. The version of the terms and conditions that apply to your order will be those that can be found on the website at the time of your order placement. 

These Terms apply to the purchasing of goods at www.noyathebrand.com for European delivery.

Order
You select the items you want to buy and put them in the “Shopping cart/basket”. You can, until the time of order, edit the contents of the shopping cart, and you can continuously check the contents and price of the goods. Any extra payments, i.e. shipping or debit card fees, will be calculated when you are ready to pay.

When you are ready to order, click on “Go to check out” where you enter your name, address, email, telephone number, payment method and choose delivery method. You can change the contents of the shopping cart until you confirm your purchase by clicking on the button “Order and Pay.”

The purchase amount will be withdrawn from your account when the product(s) is shipped.

To shop on www.noyathebrand.com you must be 18 years of age and possess a valid debit/credit card that we accept. If you are not yet 18 years of age, however, you can still purchase items if you have obtained your guardian’s consent or otherwise have a legal right to enter the purchase.

When you have ordered an item at NO_YA, you will receive an order confirmation of our receipt of your order. There is only talk of a binding purchase agreement, when you have received an order confirmation from us.
When you have ordered one or more items from us, you will receive an electronic receipt for the receipt of your order. However, the purchase agreement is only binding when you have received an email from us stating that your order is on its way.

We reserve the right to cancel a purchase contract without being liable for compensation or other expenses, in the following situations:

  • Your payment details are incorrect and cannot be verified
  • Your order is placed with the purchase of committing fraud etc. or is placed in connection with criminal or illegal acts.
  • There is an accidental error on www.noyathebrand.com, such as a payment error. 

Payment
Payment can be made using the following means of payment: IDEAL, VISA, Mastercard AND APPLE PAY. 
When paying by card the payment will be reserved on your account in accordance with the terms of your card, until we withdraw or reject the payment.
We debit the money as soon as the goods are shipped. We hold any card fees associated with your purchase.

 

Shipping 
We deliver goods to addresses in Europe. We use insured parcel service, and you will receive a track and trace number when we ship the order.
Shipments to Europe
All parcels will be shipped with one of the following transport companies: DHL, PostNL, DPD, GLS, UPS or FedEX.
The shipping method and transit time are calculated on checkout. The indicated delivery time is an indication only. Please note that longer delivery times may occur on holidays. 

 

Right of withdrawal
You can cancel your purchase without reason within 14 days. If you have purchased several items in one order, you can choose to cancel the purchase of some or all items. NO_YA does not refund delivery costs. The cancellation period expires 14 days after the day on which you or another person whom you have chosen to receive the goods (but not the carrier) get the goods. If the deadline expires on a public holiday, Saturday, Christmas Eve or New Years’ Eve, the deadline is extended to the following weekday.

After receiving the goods, only handle with care and in a way so that you can establish the nature and characteristics of the goods.
NO_YA reserves the right to refuse your return if the items are not returned to us in their original condition. Items must be unused and undamaged, and with all original hangtags/labels attached.
When trying on lingerie – please ensure you wear your own panties underneath. It is just like trying on lingerie in a normal store.
Please kindly note, we are unable to accept any returned items without tags and labels and products that have any dirty marks or/and stains.  

 

This is how you withdrawal
Write us an e-mail: info@noyathebrand.com why you want to withdraw from the contract entered and then return the product to us.

You cannot cancel by refusing to receive the item or by failing to pick it up without at the same time giving us a notice that you are cancelling the order.

Refund by cancellation
If you cancel your order before it is sent out, we will refund all payments received from you, including delivery costs. If you return your order, you will not get the delivery cost refunded.

We will refund the amount in any case no later than 30 days from the date on which we received your notice of cancellation. However, we can withhold the amount until we have received the goods back, or until you have sent documentation that the goods have been returned.

We will make such a refund using the same means of payment that you used for the original transaction unless you have expressly agreed otherwise. In any case, you will not be charged any fees because of the refund.

All we require is that the items have not been used – you can of course try them on. Just make sure that tags remain on the garments. When trying on lingerie – please ensure you wear your own panties underneath. It is just like trying on lingerie in a normal store.
Please kindly note, we are unable to accept any returned items without tags and labels and products that have any dirty marks or/and stains.  

Items must be unused and undamaged, and with all original hangtags/labels attached.

In return you should make sure that the goods are securely wrapped. You have the responsibility of the package / goods until we receive it, so keep the postal receipt and tracking number.

You must pay the costs of returning the goods when you regret your purchase.

NO_YA do not accept parcels sent with COD (cash on delivery) shipping methods. 

 

Refunds
When we receive the goods, we check it and you get paid back the amount, you have paid upon purchase (excluding of shipping costs). The amount is always transferred to the same payment method as you used to pay for the purchase with. For example, if you paid by card, your refund will be returned to that particular card.

 

Condition of the item upon return and packaging
As a consumer, you have the right to take the goods into “eyesight”, which is the same right that applies to a purchase realised in a physical store. You may after receipt only use the goods in a way that you can maintain the shape, characteristics, and the way they function. If the product is used, you can get back the price paid only partly or not at all. It is the consumer who has to pay for the potential depreciation of the item. We preserve the right to value the item according to what we can get for it in a resale.

You must return the item in its original packaging. The packaging must be opened but not destroyed. If the packaging is missing or damaged, this may constitute a decrease in value for which you are liable.
You should also ensure that the item is securely wrapped when you return it.
You may lose the right to receive back your money, in whole or in part. This happens if the product is impaired because:

  • You have actually taken the product into use,
  • It has been damaged while you were responsible for it,
  • You have used the items in another way than what was required in order to maintain the shape, characteristics, and the way they function.
  • You did not follow the requirements of our return policy regarding sealing, product type, etc.
  • You have not followed the restrictions on the right of withdrawal resulting from sealing, product type etc.
